Terms of Use for "Buat Poster Takziah"

Please read these Terms of Use ("Terms") carefully before using the "Buat Poster Takziah" mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By using this App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
2. Description of Service
The "Buat Poster Takziah" App is a tool that allows users to create condolence posters (takziah posters) by uploading and editing images locally on their devices. The App provides:
Image editing features to create condolence posters
Local processing of all images (no uploads to external servers)
Saving of completed posters to your device's local storage
3. User Responsibilities
By using this App, you agree that:
You are solely responsible for all content you create, edit, and share using the App.
You must have the legal right to use any images you upload or edit within the App. You shall not use images that infringe upon the copyrights, trademarks, or other intellectual property rights of any third party.
You shall not use the App for any unlawful, harmful, or inappropriate purposes, including but not limited to creating content that is defamatory, obscene, discriminatory, or otherwise offensive.
You are responsible for the content of the posters you create and any consequences arising from their use or sharing.
4. Intellectual Property
App Ownership: The App, including its design, layout, graphics, and code, is owned by the developer and is protected by copyright and other intellectual property laws.
User Content: All images and content you upload and edit remain your property. We do not claim any ownership over the images or posters you create.
No Transfer of Rights: These Terms do not grant you any rights to the App's source code, trademarks, or proprietary information.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
Merchantability and fitness for a particular purpose
Non-infringement of third-party rights
Uninterrupted or error-free operation of the App
Accuracy or reliability of any content generated by the App
We do not guarantee that the App will meet your requirements or that any errors will be corrected.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP. THIS INCLUDES, BUT IS NOT LIMITED TO:
Loss of data or content
Loss of profits or business
Personal injury or property damage
Any errors or omissions in the content generated by the App
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.
7. Indemnification
You agree to indemnify, defend, and hold harmless the developer and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
Your use of the App
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Any content you create, share, or distribute using the App
8. Third-Party Services
The App may contain advertisements served by third-party services such as Google AdMob. Your interactions with these third-party services are governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
9. Termination
We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.
Upon termination, your right to use the App will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
11. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
12. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the developer regarding your use of the App and supersede all prior agreements and understandings.

3. 用户责任
使用本应用即表示您同意：
您对使用本应用创建、编辑和分享的所有内容承担全部责任。
您必须拥有合法权利使用您在本应用内上传或编辑的任何图片。您不得使用侵犯任何第三方版权、商标或其他知识产权的图片。
您不得将本应用用于任何非法、有害或不适当的目的，包括但不限于创建诽谤、淫秽、歧视或其他令人反感的内容。
您对所创建海报的内容及其使用或分享所产生的任何后果负责。
4. 知识产权
应用所有权：本应用及其设计、布局、图形和代码归开发者所有，受版权和其他知识产权法律保护。
用户内容：您上传和编辑的所有图片和内容仍归您所有。我们对您创建的图片或海报不主张任何所有权。
权利不转让：本条款不授予您对本应用源代码、商标或专有信息的任何权利。
5. 免责声明
本应用按“现状”和“现有”方式提供，不附带任何明示或暗示的保证。在法律允许的最大范围内，我们不提供任何保证，包括但不限于：
适销性和特定用途的适用性
不侵犯第三方权利
本应用运行不间断或无错误
本应用生成的任何内容的准确性或可靠性
我们不保证本应用能满足您的要求，也不保证任何错误会得到纠正。
6. 责任限制
在适用法律允许的最大范围内，开发者在任何情况下均不对因您使用或无法使用本应用而引起的或与之相关的任何直接、间接、附带、特殊、后果性或惩罚性损害赔偿承担责任。这包括但不限于：

利润或业务损失
人身伤害或财产损失
本应用生成的内容中的任何错误或遗漏

您同意赔偿、捍卫并使开发者及其关联方免受因以下原因引起的或与之相关的任何及所有索赔、责任、损害、损失、成本和费用（包括合理的法律费用）：

8. 第三方服务

9. 终止

10. 管辖法律
本条款应受马来西亚法律管辖并据其解释，不考虑其法律冲突规定。因本条款引起的或与本条款有关的任何争议应提交马来西亚法院的专属管辖。
11. 可分割性
如果本条款的任何规定被认定为无效、非法或不可执行，其余规定应继续保持完全效力。无效规定应进行最小程度的修改以使其有效和可执行。
12. 完整协议
本条款连同我们的隐私政策构成您与开发者之间关于您使用本应用的完整协议，并取代所有先前协议和谅解。
